It is made to slide under the rear sight and bolt through it. The scope mount is just that. It is a plate attached to the gun upon which rings and a scope are mounted. You do have to do a slight mod. the marlin does not have a hole for the mount at the stock, simple fix, get a 3/4 self drilling bolt and drill through the receiver and into the stock, it does no harm.
